We strive to maintain uptime of at least 99.5% monthly but we do not guarantee this in any way. workbeyond.io / YobiBIT S.R.L. does not guarantee continuous or uninterrupted access and use of the software platform. There is a possibility that the application may not be available for technical reasons or any other circumstances, not related to workbeyond.io / YobiBIT S.R.L.
You understand and agree that the workbeyond.io Website or Services may be unavailable due to scheduled maintenance. We reserve the right to prevent or limit access to the Website or Services for security, upgrades or other reasonable purposes.
You understand and agree that no representation or warranty is made with respect to the functionality or availability of the workbeyond.io Website or Services and that all or any portion(s) of the Website or Information on workbeyond.io may for a variety of reasons be unavailable to You for use either temporarily or permanently without notice.
You further agree and understand that Information and data related to the Website may be irretrievably lost or destroyed at any time, and it will be your responsibility to make all necessary copies and backups of any appropriate Information and data posted to or obtained or available from workbeyond.io.
You agree that workbeyond.io, its licensors and suppliers will have NO LIABILITY due to your inability to access the workbeyond.io Website, Services, the Information, any portion thereof or any related data or information, and will not have any liability in connection with the loss or destruction of any such data or Information.
The User understands that the use of any device, scraper software or any other feature that could interfere with the activities and operations of workbeyond.io and its software is not allowed. Any interference, attempt or activity that violates or contravenes intellectual property rights and/or the prohibitions provided in the Terms and Conditions will make the perpetrator liable through appropriate legal actions and, at the same time, responsible for paying possible damages in compensation.
You understand and acknowledge that no website or network is immune from unauthorized access. Accordingly, workbeyond.io / YobiBIT S.R.L. will have NO liability or responsibility in connection with any unauthorized access to the Website or Information.
workbeyond.io / YobiBIT S.R.L. is not responsible for any damage, loss or deterioration of the Visitor’s or User's equipment caused by malfunctions in the systems, servers, software apps, Internet, power availability, etc.
The User agrees that s/he cannot hold workbeyond.io / YobiBIT S.R.L. liable and cannot have any material or other claim due to losses resulting from technical problems of the workbeyond.io platform. If the technical failures are longer than 5 consecutive business days, a paying user on workbeyond.io may be compensated, in Our sole discretion, but the compensation can not exceed in any circumstance EUR 10. No compensation will be paid, under any circumstances, to non-paying users of workbeyond.io.
Limitation of liability
The User understands and expressly agrees that workbeyond.io is not liable to the User in any direct, indirect, incidental or special situation arising from the use of workbeyond.io or Services.
We shall at no time accept liability for any damage of whatever nature arising from the use of 3rd Party websites, which are in any way linked to our Website or Services, nor shall we be held responsible for the collection and use of credit card or any other personal information by any of the third Party websites. At the same time, workbeyond.io will not be liable for the omission of any of the legal obligations imposed on third Parties by the laws and normative regulations in force. Our Website and Services function exclusively with the aim of facilitating the connection between Users and potential Employers (3rd Parties). No responsibility can be attributed to workbeyond.io / YobiBIT S.R.L. for any errors arising from the practice of the activity of 3rd Parties (including without limitation: employer listed job postings, credit card and any other personal information processing) you might be requested to give to any 3rd Party, and you irrevocably waive any claim against workbeyond.io / YobiBIT S.R.L. with respect to such 3rd Party websites. The User agrees, in the event of misunderstandings arising from the act of providing service by 3rd Parties, to directly take action against the 3rd Party.

MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY workbeyond.io WEBSITE OR YOUR USE OF THE SERVICES, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED EUR 10. Indemnification
To the maximum extent permitted by applicable law, you agree to defend (at the indemnified party's option), indemnify and hold workbeyond.io/YobiBIT S.R.L. and its respective partners, principals, shareholders, employees, licensors, agents, affiliates, business associates, suppliers and insurers harmless from and against any and all losses, damages, liabilities, costs (including reasonable attorneys' fees) and expenses in connection with any claim arising out of or in connection with any content or Information posted or transmitted by you using workbeyond.io or Services, or that otherwise arise out of your use of the Website, Services or the services of any other 3rd Party. At any time, workbeyond.io has the right to forego the indemnification and assume the defense of any claim. You agree that if We have to engage in any type of legal proceedings against You to enforce the Terms of this agreement, You will be responsible for all fees and costs incurred by Us in such efforts including, but not limited to, workbeyond.io / YobiBIT S.R.L. attorneys’ or mediator’s fees.
Governing law
THESE TERMS AND CONDITIONS WILL BE GOVERNED BY AND ENFORCED IN ACCORDANCE WITH THE LAWS OF ROMANIA, AN EUROPEAN UNION MEMBER STATE, WITHOUT REGARD TO CONFLICT OF LAWS PRINCIPLES. YOU IRREVOCABLY CONSENT TO THE EXCLUSIVE JURISDICTION AND VENUE OF COURTS AND ARBITRATORS (MEDIATORS) LOCATED IN BUCHAREST/ROMANIA AND SERVING THE CITY OF BUCHAREST/ROMANIA, IN CONNECTION WITH ANY DISPUTE OR CLAIM ARISING UNDER THESE TERMS AND CONDITIONS. EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY RIGHT THAT IT MAY HAVE TO ASSERT THAT SUCH FORUM IS NOT CONVENIENT. EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY AGREES NOT TO DEMAND A TRIAL BY JURY, CLASS ACTION OR CLASS ARBITRATION IN ANY ACTION, PROCEEDING, CLAIMS, COUNTERCLAIMS, CROSS-CLAIMS, OR THIRD PARTY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS, THE WEBSITE OR THE INFORMATION. FURTHER, EACH PARTY HERETO CERTIFIES THAT NO REPRESENTATIVE OR AGENT OF EITHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH PARTY WOULD NOT IN THE EVENT OF SUCH LITIGATION, SEEK TO ENFORCE THIS WAIVER OF RIGHT TO JURY TRIAL, CLASS ACTION OR CLASS ARBITRATION PROVISION. EACH OF THE PARTIES ACKNOWLEDGES THAT THIS SECTION IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY ENTERING INTO THIS AGREEMENT. You and We hereby agree to waive any right to a jury trial, class arbitration or class action and agree that You and We may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, irrespective of when and how any dispute, claim, or controversy arose—whether based in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. You and We further agree that any dispute, claim, or controversy relating in any way to or arising in any way out of these Terms, Our Website or Services shall be resolved exclusively through final and binding individual arbitration or mediation (via a single authorized Romanian mediator based in Bucharest, Romania), in English, rather than in Court, and You shall submit to the arbitration rules of such jurisdiction. Either Party may initiate arbitration of a Dispute upon completion of the Informal Dispute-Resolution Process for that Dispute. The arbitrator (mediator), and not any federal, state, or local court or agency, shall have exclusive authority to resolve any and all Disputes arising out of or relating to the formation, existence, scope, validity, interpretation, applicability, or enforceability of this agreement to arbitrate, or any part of it, or of these Terms, including, but not limited to, any claim (except as explicitly outlined below) that all or any part of this agreement to arbitrate or the Terms of Use is void or voidable. If any Party disagrees the Parties agree that the arbitrator(mediator) will decide that Dispute.
The Dispute resolution process:
Either Party in good faith will first try to resolve any dispute by giving a Dispute written notice to the other Party, describing all relevant facts. Send Us any such notice to contact@workbeyond.io. We will send You Ours to the email contact information we have about You from You, only. If no such information exists or if such information is not current, then, we have no obligation under this section. For a period of ninety (90) days from the date of receipt of notice from the other Party, You and workbeyond.io/YobiBIT S.R.L. will attempt in good faith to resolve the Dispute, though nothing will require either Party to resolve the Dispute on terms that either Party, in each of its sole discretion, finds unacceptable. If no solution will be found during the 90 days grace period, You agree that a Romanian registered and authorized mediator, as described above, will be contacted by Us and requested to handle the respective Dispute resolution process for You and workbeyond.io/YobiBIT S.R.L..
Exceptions: The Dispute resolution process via arbitration or mediation will not apply in cases where the Romanian law does not permit it or in intellectual property Disputes. In such cases Courts located in Bucharest, Romania will have exclusive jurisdiction, as stated above.
THE 1980 UN CONVENTION ON CONTRACTS FOR INTERNATIONAL SALE OF GOODS WILL NOT APPLY TO THIS AGREEMENT.
Payment / billing and subscriptions
You shall pay all fees or charges to Your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If auto-renewal is enabled for the Product/Service You have requested, You will be charged automatically in accordance with the terms You agreed to. If, in Our judgment, any of Your payments or transactions constitute a high-risk transaction, We will require You to provide us with a copy of Your valid government-issued photo identification, and any other additional documents required by Us, to verify compliance with applicable laws, policies and procedures. We reserve the right to change Products and Product pricing at any time.
Depending on where you transact with us, the type of payment method used and where your payment method was issued, your transaction may be subject to foreign exchange fees or differences in prices due to exchange rates. Your transaction may also be subject to foreign currency exchange fees assessed by your bank or card issuer. We are not responsible for any foreign currency exchange fees or surcharges and will not make any compensation or reimbursement for charges imposed by Your bank or card issuer. We do not support all payment methods, currencies or locations for payment. If the payment method You use with Us, such as a credit card, reaches its expiry date and You do not edit your payment method information or cancel Your Account or the applicable service, You authorize us to continue billing that payment method and You remain responsible for any uncollected amounts. Your obligation to pay fees continues through the end of the subscription period until You cancel your subscription. All applicable taxes are calculated based on the billing information You provide at the time of purchase.
We may, in Our sole discretion, limit or cancel access to Products/Services purchased per person or entity. These restrictions may include Products/Services requested by or under the same customer account, the same credit card, and that uses the same billing and/or shipping address. In the event that We make a change to or remove a Product, We will notify You via the e-mail You listed on the Platform.
Credit card processing services on workbeyond.io are provided by Stripe, a PCI/DSS compliant major credit card payments processor who processes credit card transations for Your transactions on Our behalf. Your credit card data is with Stripe and recurrent billing changes, for your subscription with Us, will be performed by You, via Your account on workbeyond.io, directly in Stripe, as you deem necessary. You can opt-out at any time.
We will not be liable for any acts or omissions by You, including processing of payments to You on the basis of inaccurate information on Your account, or any damages of any kind incurred as a result of such acts or omissions.
User Account and associated User Data
In the context of the workbeyond.io Website, We are the data controller for Your information, per the applicable EU/GDPR regulations. We do not own Your data, You own it, and You retain ownership of your User Data at all times in the context of our Website. We will only process your User Data as described in our Privacy policy and under these Terms.
User Data, valid email address
You must supply and maintain a valid and verified email address in order to use this Service. Invalid email addresses and those that have not been verified through the verification email sent upon sign-up will be deleted from our system and you will be denied access to this Website. You agree to provide true, accurate, current and complete information about yourself as prompted by the Our Service registration form and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You are responsible for all activities that occur under your User Account.
As a Registered User, you may upload, post, share, transmit or otherwise make available your User Data through the Service. User Data means, without limitation, your Account information, CV/resume, career history, educational history, videos, photos, pictures, audio, profile entries, posts, job post or application information, company logos, questions, career materials, testimonials, submissions, and/or any other information You provide on or through the Service or that We may create for You (“User Data”). When You create an Account or provide career information on or through the Service (including via forms available on the Site or by uploading or creating a job post), You agree that You are solely responsible for the accuracy of your User Data. You agree that workbeyond.io may offer information that We deem of interest to You, including via email.
In the future we may offer as part of the Service a publicly available searchable CV/Resume database to which anyone can have access. When you decide to share a CV/Resume you will be automatically included as part of the database and your CV/Resume will be searchable by anyone, unless you actively opt-out. We will not show your address, phone number, or email address unless you have agreed to make this information available or it is contained in Your CV/Resume. When sharing your CV/Resume, you do so at your own risk. You indemnify Us as per the Indemnification section in these Terms against any and all claims, demands, liabilities, costs or expenses, including reasonable legal fees, resulting from your use of CV/Resume and its inclusion on our public resume database.
You grant us an irrevocable, worldwide, perpetual, non-exclusive, royalty-free, sublicensable through multiple tiers, and transferable, license to use, copy, reproduce, process, adapt, modify, publish, transmit, distribute, prepare derivative works of, display, and list User Data in connection with the Service and workbeyond.io (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels (known now or developed later) Your User Data, under these Terms and our Privacy Policy. You grant each User of the Service a non-exclusive licence to access your public User Data, and to use, reproduce, distribute, display and perform such User Data as permitted through the functionality of the Service and under these Terms.
Limitations on Use
Only one individual may access workbeyond.io at the same time using the same email or password, unless we agree otherwise. workbeyond.io reserves the right, at our sole discretion, to immediately revoke your account and/or assess a penalty fee for scraping profiles, copying copyrighted text, or otherwise mis-using or mis-appropriating site content and Information, including but not limited to, use on a “mirrored”, competitive, or third party website.
The following are examples of the kind of activity or User Data that is illegal or prohibited on the Website and through Your use of the Services. We reserve the right to investigate and take appropriate legal action against anyone who, in Our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity or User Data on the Website includes, but is not limited to CVs/Resumes or Cover Letters which promote of contain in any way Information that, in our opinion, promotes:
* criminal or tortious activity, pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
* commiting any actions considered to be unethical, including but not limited to use of profanity, hatred, racial discrimination, harassment or verbal abuse in the Member profiles, User Data, posts or email messages
* advertising to, or solicitation of, any User to buy or sell any products or services through the unauthorized or impermissible use of the Services; You may not transmit any chain letters or junk email to other Users; in order to protect our Users from such advertising or solicitation, We reserve the right to restrict the number of listings or messages a User may see or send to other User to a number which We deem appropriate in Our sole discretion
* posting identical or similar Information multiple times for the same or very similar request
* circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the Website or Services;
* activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network;
* posting content in Your profile embedded in HTML/CSS;
* any automated use of the system, such as, but not limited to, using scripts to to scrape Information, to send messages, to create profiles or to communicate with Users;
* interfering with, disrupting, or creating an undue burden on the Services or the Website;
* misrepresenting yourself or impersonating or attempting to impersonate another User, person or entity in any way through profile postings of Information, via any method; We may request You to send Us a scan of your government issued ID, as part of Our KYC efforts, in our sole discretion
* using the account, username, or password of another User at any time or disclosing your password to any third party or permitting any third party to access your account;
* selling or otherwise transferring your profile;
* resell data containing other Users' profile or personal information or any other information on the Website
* using any Information obtained from the Website or Services in order to harass, abuse, or harm another person or entity, or attempting to do the same;
* displaying an unauthorized commercial advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity through the unauthorized or impermissible use of the Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, or sending private messages with a commercial purpose;
* attempting to deliberately solicit members to leave the Website in favor of another related or competitive service, or
* using the Services in a manner inconsistent with any and all applicable laws and regulations.
Commercial advertisements, affiliate links, and other forms of unauthorized solicitation may be removed from User profiles without notice or explanation and may result in termination of Membership privileges.
When You submit Your CV/Resume to a 3rd Party website linked in any way from our Website, Your data will be outside of our control. When you apply to a job listed on our Platform We only record the fact that you applied to that position but the systems/recruiting software You will send your job application data to are external to our Platform, outside of Our control, and therefore We make no representations as to the suitability of the external 3rd parties processing Your User Data and We accept no liability in relation to this. Please perform Your own due dilligence in relation to any other webservice or 3rd Party (we strongly encourage you to read their Privacy Policy and Terms and Conditions). We accept no responsibility or liability for this, as stated in these Terms and in our Privacy Policy.
You warrant that you are of age, at least 18 years old, and entitled to enter into these Terms and that Your User Data does not infringe the proprietary or privacy rights of any third party. Please act responsibly when using the Service. You may only use the Service and its contents for lawful purposes and in accordance with applicable law and you are prohibited from storing, distributing, or transmitting any unlawful material through the Service.
Termination
At our sole discretion and without prior notice We may suspend, disable, or delete Your account (or any part thereof) and discontinue any Services, if we determine that You have violated any provision of these Terms, any other terms You have agreed to, or that Your conduct or content would damage Our reputation and goodwill. We accept no liabilities for any damages associated with the termination or suspension of a User’s account. Users cancelled or suspended from the workbeyond.io Website or any affiliated Services will not receive any refunds whatsoever and will not be eligible to become Users of the Website again.
Job listings
We make serious efforts to update the job listings on the Website very frequently. However, some external listings may expire at any time or contain inapropriate information, as they contain external data that are not under Our control. You can report this to Us via the links embedded in the respective job listing webpage on Our Website.
We reserve the right to correct any errors, inaccuracies or omissions, and to change or update any Information on our Website as we deem fit, in our sole discretion. We undertake no obligation to update, amend or clarify information on the Platform including, without limitation, pricing information, except as required by law.
